Judicial Committee Appeal Petition

This appeal petition has already been filed with the Libertarian Party's Judicial Committee under the subject matter jurisdiction for the suspension of state affiliates.  A motion was passed by the LNC which requires the Libertarian Party of Delaware to hold a "general membership meeting" to determine who the legitimate leadership is of the Delaware affiliate.  In the event that two competing meetings are held, the meeting with the highest attendance "wins".  The LNC's determinations have no bearing on the legal status of the Libertarian Party of Delaware as a ballot qualified political party under Delaware's ballot access laws, and only a Delaware court can overrule the decisions of a majority of the Libertarian Party of Delaware's elected Board.

Furthermore, the LNC has no authority under its existing bylaws to abridge the autonomy of state affiliates, and the Libertarian Party of Delaware's bylaws have no provisions for holding "general membership meetings" or determining leadership in election years.  We consider this to be a constructive disaffiliation.  A disaffiliation is still a disaffiliation even if it is not labeled as such and the more stringent requirements for suspending a state affiliate are not followed.

However, the Judicial Committee may not agree that this is a constructive disaffiliation and grant us a hearing under that aspect of their subject matter jurisdiction.  In anticipation of this possibility, we are collecting signatures from 10% of the 2020 LP Convention's delegates or 1% of the LP's sustaining members under which any decision of the LNC can be appealed.
