We have spoken to an attorney. His advice was to try to file a lawsuit first rather than waiting for the legal action that has been threatened by the MCDE faction. This will allow us to establish the narrative and choose the more favorable venue. The cause of action will be the recovery of financial assets still under the control of the MC dominated former New Castle County affiliate. Any legal case, from either side, will hinge on proving that our actions conformed to the requirements specified in our governing documents. We are confident in this case, but getting that case in front of a judge is the challenge.
Lawsuits may also be filed to enforce our ballot access or prevent them from hijacking it. These suits will also put the central question of the expulsion procedures front and center.
